3. Rescheduling & Cancellation

Clients may request to reschedule sessions with advance notice (typically 30 days, unless otherwise stated). Cancellations made without sufficient notice may result in forfeiture of the retainer or service fee. In cases of emergencies or inclement weather, we will work with clients to find a suitable alternative.

4. Intellectual Property

All content on our website, including but not limited to images, videos, logos, copy, and design, is the property of Cherlyn Eliza Photography, LLC and is protected by copyright and intellectual property laws (USC Title 17). You may not:

• Reproduce, distribute, or commercially exploit our content
• Claim ownership or misrepresent the origin of our work
• Share client galleries without permission, unless explicitly allowed

Licensed usage may be granted under specific terms via written agreement.

5. Client Image Usage

By booking with us, you grant us the right to use photos from your session for promotional purposes (e.g., website, social media, portfolio), unless you notify us in writing prior to your session. We respect your privacy and will honor requests for confidentiality.

6. Limitations of Liability

While we strive for excellence, we are not liable for:

• Losses due to technical failure (e.g., camera malfunction, file corruption)
• Missed sessions due to client tardiness or miscommunication
• External factors beyond our control (e.g., weather, force majeure)

In no case shall our liability exceed the amount paid by you for the specific service.

7. Third-Party Links

Our website may include links to third-party websites. We are not responsible for the content or privacy practices of these external sites.

8. Termination

We reserve the right to terminate access to our services or website at our discretion, especially if a user violates these Terms.

9. Dispute Resolution

In the event of a dispute, both parties agree to seek resolution through informal negotiation. If unresolved, the dispute shall be handled through binding arbitration or in the courts of Washington, under the laws of that jurisdiction.
